Please read these terms and conditions carefully. These terms and conditions govern your submission of a nomination for someone to be considered in the selection process to carry the Baton (“Batonbearer”) as part of the Queen’s Baton Relay (the “Take It On Campaign”).

If you, as the nominator, are under 18 years old, you must ask your parent/guardian for permission to submit your nomination.  Your parent/guardian must agree to these terms and conditions.

The promoter of the Take It On Campaign is the Birmingham Organising Committee for the 2022 Commonwealth Games Ltd (“Birmingham 2022“).  If you have any queries about the Take It On Campaign or these terms and conditions then please contact us at https://helpcentre.birmingham2022.com/.

Opening and closing dates, eligibility

1. The Take It On Campaign will open for nominations (“Nomination”) at 10.00am on 10 January 2022 and close for Nominations at 23:59 on 14 February 2022 (the “Closing Date”). Nominations must be received before the Closing Date and any Nomination forms received after this date/time will not be considered.

2. You, as the nominator, must be at least 18 years old or if you are under 18 old you must ask a parent/guardian to provide their contact details on the Nomination form instead of yours.

3. You must nominate an individual (the “Nominee”).

4. Nominees may be under 18 years old but, if they are, you must obtain permission from their parent/guardian before you nominate them. By nominating them you confirm that you have obtained this permission.

5. Any individual Nominee must be a UK citizen or has permission to reside in the United Kingdom, live and/or work in England and be 12 years old or older.

6. Eligibility requirements set out in conditions 2 to 5 must be met on the Closing Date. Birmingham 2022 reserves the right to verify the eligibility of (a) you, as the Nominator, and (b) any Nominee. Birmingham 2022 may require information (including requesting proof of your age, as nominator, as well as parental or guardian’s consent) as it considers reasonably necessary for this purpose.

Nominations

7. Internet access is required to submit a Nomination.

8. To submit a Nomination for the Take It On Campaign, you, as the nominator, will need to visit the website at www.Birmingham2022.com, complete and submit the ‘Batonbearer’ Nomination form.

9. On the Nomation, you, as the nominator, will need to nominate a Nominee who meets the eligility criteria set out in condition 5.

10. A Batonbearer can be someone who meets one or more of the following criteria:

  • always willing to take on a challenge and has a unique and inspiring story;
  • has made a meaningful contribution to sport, education, the arts, culture, or charity;
  • is a figure of inspiration that positively challenges others to achieve their best;
  • has taken on a challenge or cause and made a positive impact within their community.

11. You, as the nominator, will need to provide all information requested in the Nomination form, and must include the following information in a clear, legible form:

  • if you are over 18, your (as the nominator) contact details (full name and email address) OR if you are under 18 years old your parent/guardian’s contact details (full name, email address and telephone number);
  • the name of the Nominee (full name);
  • the Nominee’s email address;
  • the region the Nominee lives in; and
  • a short narrative of no more than 100 words detailing why you, as the nominator, believe the Nominee is deserving of being named a Batonbearer.

12. Contact details provided and other information submitted or reviewed by Birmingham 2022 in connection with the Nomination will be used in accordance with our Privacy Notice.

13. Please note that is we are not able to contact the Nominee (because we do not have contact information or the contact information is not correct), then we reserve the right to exclude them from the Take It On campaign.

14. By completing the nomination form, you must confirm that you have informed your Nominee that you have nominated them for the Take It On Campaign and made them aware of these terms and conditions.

15. You, as the nominator, must not include anything in your Nomination about the Nominee’s:

  • physical or mental health or condition;
  • sexual life;
  • racial or ethic origin;
  • political opinions;
  • religious or similar beliefs; or
  • trade union membership.

16. You, as the nominator, must not include anything in your Nomination about the commission or alleged commission of any offence by an individual or any proceedings for any offence committed or alleged to have been committed by any individual (or the findings or sentence of any court, including ex-convict status).

17. Birmingham 2022 reserve the right to disqualify late or illegible Nominations. Birmingham 2022 cannot take any responsibility for any technical failure or malfunction which may result in any Nomination being lost or not properly registered or recorded.

18. There is no restriction on the number of nominations you may make.

Screening of Nominations

19. Birmingham 2022 reserves the right to disqualify any Nominations if:

  • they are submitted using automated means – e.g. a computer program, script or device, or any other method or technique designed to unfairly increase the chances of a Nominee winning the Take It On Campaign;
  • submitted in bulk by any third party;
  • made in breach of these terms and conditions;
  • nominate individuals who are ineligible under these terms and conditions;
  • include information that is considered Special Categories of Data, regarding the commission or alleged commission of any offence; or the proceedings for any offence committed or alleged to have been committed by any individual (or the findings or sentence of any court);
  • relate to a Nominee who does not, if and when contacted by Birmingham 2022, agree to participate in the process on the basis of these or other applicable terms and conditions, and any applicable requirements of Birmingham 2022;
  • they are deemed to include inappropraite, discriminatory, illegal or offensive content;
  • they are duplicates or not legitimate;
  • they are dishonest Nominations;
  • parents’ or guardians’ consent has not been obtained; and
  • in the reasonable opinion of Birmingham 2022, they do not constitute a positive endorsement of a Nominee or would bring Birmingham 2022 into disrepute.

You, as the nominator, shall ensure, as far as is possible, that you do not make any Nomination referred to in this condition 19.

20. Nominations submitted as part of the Take It On Campaign shall be reviewed by an independent selection panel.

21. Birmingham 2022 will undertake background checks of the Nominees to ensure that Nominees will be positive role models suitable for selection as a Batonbearer who would not be likely to adversely affect the reputation of Birmingham 2022 or the Queen’s Baton Relay. Information provided or discovered as part of or during the selection process will inform the decision as to the continuation of the Nominee(s) in the Batonbearer selection process (which shall be at Birmingham 2022’s sole discretion).

General

22. Any decision of Birmingham 2022 as to the eligibility to submit a Nomination or take part in the Take It On campaign, or as to the selected Nominees, will be final and no correspondence will be entered into.

23. If you or your Nominee do not hear from Birmingham 2022, this means your Nominee has not been shortlisted as Batonbearer.

24. Birmingham 2022 reserves the right to delay, postpone or cancel the Take It On Campaign if deemed necessary to do so in its opinion, or in the event circumstances outside its control arise.

25. The Take In On Campaign and these terms and conditions are governed by the laws of England and Wales. If you, as the nominator, are a resident of Northern Ireland, Scotland, the Channel Islands or the Isle of Man, then they will additionally be entitled to bring an action in their home court.
