1. Terms and Conditions

1.1 We, LG Electronics S.A. (Pty) Ltd ()Inc. are pleased to provide you with the service set out in these terms and conditions (Terms). The service we are providing is the facilitation of the Campaign discussed below (Service). These Terms make up the agreement between you and us in relation to the matters discussed in these Terms. These Terms are to be read in conjunction with our Privacy Policy, which can be found here: https://www.lg.com/za/privacy

Agreeing to the Terms.

2.1 By clicking the consent box or submitting your information as contemplated in the section below titled “The Campaign” (Information), you i) agree to these Terms, agree to our Privacy Policy, and agree to provide your Information, ii) confirm that you are legally eligible to agree to these Terms, to agree to our Privacy Policy, and to agree to provide your Information – or if relevant, you confirm that you have obtained necessary assistance and consent of your guardian such as a parent in accordance with South Africa law, iii) agree for us to use your Information in the manner set out in these Terms and/or in our Privacy Policy, iv) agree that we can use your Information to contact you in the future about things we think you might be interested in aside from the Campaign, and v) acknowledge that the Information you provide could be Personal Information as defined in the Privacy Policy.

Reviews and other content

3.1 If you post content, which could include a review, on an lg.com page, or if you submit content to be posted on an lg.com page, you grant us a worldwide, nonexclusive, royalty-free, transferable, and sub-licensable right to use, publish, reproduce, create derivative works from, and modify and such content. This includes us having the right to repost the content on an lg.com page that is different from the lg.com page for which you supplied the content; it is possible for us to transfer or sublicense such reposting right to companies related to us. Also, in connection with any content you post or submit for posting, (i) you grant us and companies related to us the right to use the name you submit and (ii) you confirm that you own or control all of the rights to the content and that the content is accurate.

3.2 We have the right but not the obligation to monitor and edit or remove any content.

4 The Campaign

4.1 Once you submit your Information using the required online form, you will be eligible to participate various activities. The Campaign consists of three activities: “Life’s Good Restaurant”, “Dance Challenge”, and “Game Challenge”. An individual can participate in one, two, or all three of the activities. The activities are described on the Campaign website (Microsite), which is introduced in each Campaign.

4.2 The Microsite is owned and operated by us. In case you win a prize (Prize), to enable you to receive the Prize, we will share your Information with our local distributor(s) and potentially with other entities involved in the Campaign. By submitting your Information, you agree that we can share your Information as described in this paragraph and, more generally, that we can deal with your Information within the bounds of what is described in the Privacy Policy.

7. Game Challenge campaign

7.1 Requirements:

• The participant must register in the microsite link lg.com/za/spotoftriumph by providing all the necessary details. • Participants must include their Epic Games ID or Display Name. • Participants must be a minimum of 12 years’ old. • Participants must be a local or a resident of South Africa. • Any player caught participating from an outside the campaign country will not be eligible to claim prizes • Solo Mode only • The registration will be open for the duration of the campaign

7.2 Competition Rules:

• Once a participant submits their Epic Games ID, their performance will be tracked throughout the week • The participants' progress is based on multiple factors • Wins = You earn more points if you get Victory Royale • Top 10 = You earn points based on your placement in your matches • Top 25 = You earn points based on your placement in your matches (less points than 10) • Kills = The more kills you get the more points you earn • An example of the highest-earning score: Victory Royale + Top 10 Placement + High # Kills • If your match placement is higher than 25, you will earn 0 points but your eliminations will still count • We will track your progress every week for 4 weeks • A leaderboard will be created every week • Each week, the top highest earning points will win a prize from LG Electronics. • The leaderboard resets every end of the week and a new leaderboard will be created for the week that follows • Each week's leaderboard score for the registered participants will be saved even after it resets • After all, 3-week leaderboards are done, a Final leaderboard will be created as a compilation of the 3 weeks' leaderboards

7.3 Campaign duration:

November 4th – November 28. • 1st week will start from the 4th of November till 6th of November, Winners' announcement November 8th. • 2nd week will start from 11th November till 13th November Winners' announcement November 15th. • 3rd week will start from 18th November till 20th November, Winners' announcement November 22th. • Final week will start on 21st September till 22nd November, Winners' announcement November 27th. • If you register in Week 1, you will be placed in the leaderboard of Week 1, 2, 3, and Final. • If you register in Week 2, you will be placed in the leaderboard of Week 2,3, and Final. • If you register in Week 3, you will be placed in the leaderboard of Week 3, and Final. • Players performance is tracked to identify the players (by country) who have achieved the highest number of top 10 placements during the 48-hour period that week. • Players will be able to view their leaderboards on their respective localized LG.com microsite. • Prizes: Weekly prizes for the first 3 weeks are: One LG monitor for (1) winner each week. • For final week the top 25 players from each country after the three weeks’ challenges (Scores from all 3 challenges combined) will compete in the creative challenge for the ultimate prize. This format will engage the players from all 3 weeks, and allow the players that did not win every week to compete for a prize. • The players will be engaged to design the LG logo in the creative mode of Fortnite (mechanic TBA between all parties). The players will record their gameplay to be eligible to win so we can create content from the submissions. • Countries: All countries play together. • Prizes: Winner will receive the ULTIMATE GAMING SETUP – LG PRODUCT SUITE AND X BOX PRODUCT SUITE (TBA).

Schedule of the Campaign stated herein and/or number of phases may be changed without any notice depending on circumstances.

7.4 Unprofessional Behavior

Set forth below is a non-exclusive list of examples of unprofessional behavior, all of which are prohibited.
Harassment. Harassment is prohibited. Harassment is defined as systematic, hostile and repeated acts taking place over a period of time, or a singular egregious instance, which is/are intended to isolate or ostracize a person and/or diminish the dignity of the person.
Sexual Harassment. Sexual harassment is prohibited. Sexual Harassment is defined as unwelcome sexual advances. The assessment is based on whether the person being harassed would regard the conduct as undesirable or offensive. There is zero tolerance for any sexual threats/coercion or the promise of advantages in exchange for sexual favors.
Discrimination and Denigration. Participants may not offend the dignity or integrity of a country, private person or group of people through contemptuous, discriminatory or denigrating words or actions on account of race, skin color, ethnic, national or social origin, gender, language, religion, political opinion or any other opinion, financial status, birth or any other status, sexual orientation or any other reason.
Negative Statements. Participants may not make, issue, authorize or publish any statement that is prejudicial or detrimental to the best interests of the LG GAME CHALLENGE and Tournament Organizer
Illegal Activity. Participants are required to comply with all applicable laws at all times. A participant may not engage in any activity which is in violation with laws, regulations or public security administration rules.
Immoral Activity. A participant may not engage in any activity which, in the sole determination of the Tournament Organizer, is unethical, immoral or disgraceful.
Bribery. No Participant may offer any gift or cash or other reward to other Participant, LG GAME CHALLENGE Official, the Tournament Organizer or any other person connected with or employed by another Team in order to influence the outcome of a Game.
Gifts. No Participant may accept any gift, reward or compensation from another player in connection with the challenge.
Non-Compliance. No Participant may refuse to comply with the instructions or decisions of the Tournament Organizer or the LG GAME CHALLENGE Officials.
Match-Fixing. No Participant may offer, agree, or conspire to fix a match or take any other action to intentionally and unfairly alter, or attempt to alter, the results of any Game (or any play or component thereof). Match-fixing will be subject to maximum penalty in each instance. If a Participant is asked to “fix” the outcome of a Game or to otherwise take part in any actions prohibited by these Competition Rules, that Participant must immediately report this request to the Tournament Organizer

7.5 Disciplinary Action and Sanctions

Investigations by the Tournament Organizer. The Tournament Organizer will have the right to monitor compliance with these Competition Rules and the Registration Rules and investigate possible breaches. By agreeing to these Competition Rules, each Participant agrees to cooperate with the Tournament Organizer in any internal or external investigation that the Tournament Organizer conducts relating to a suspected violation of these Competition Rules, the Registration Rules or applicable law. Participants have a duty to tell the truth in connection with any investigation conducted by or for the Tournament Organizer and have a further duty not to obstruct any such investigation, mislead investigators or withhold evidence. Repeated Infractions. Repeated infractions are subject to escalating penalties, up to, and including, disqualification from participation in the LG GAME CHALLENGE.

7.6 Prizes

In general, the prizes earned by a player will be delivered directly to the player. Each player that has been declared the winner of a prize in the challenge will not be an official winner unless (i) the player is eligible to receive the prize under applicable law; (ii) the winning player has a parent or legal guardian receive the prize on their behalf. The failure to take delivery of any prize within a reasonable time after the close of the Tournament may result in forfeiture and loss of the prize.

8 Acceptance of the Competition Rules:

You hereby acknowledge receipt of, or access to, the Competition Rules. You understand that your compliance with the Competition Rules is a condition of your participation as a player in the LG GAME CHALLENGE. You acknowledge that the tournament organizer and its affiliates and subcontractors (including any third-party tournament organizer designated or retained to operate a LG GAME CHALLENGE Event reserve the right in their sole discretion to impose discipline for any conduct that violates the Competition Rules, including public reprimands, fines, suspensions, debarment and/or disqualifications. You have carefully read, and you understand the Competition Rules, and agree to be bound by their term. You understand and support the standards set forth in the Competition Rules, and you will act in accordance with them. • The participant is responsible for providing the correct Epic Games ID, if entered incorrectly progress will not be tracked until the correct ID has been shared • Employees and family members of LG Electronics and PLG are not eligible to claim a prize if they register for the event. • Prizes can be claimed by individuals who reside in KSA, Egypt, Nigeria, South Africa, Turkey only • Eligibility for prizes will be based on tournaments official score mechanic, as well as official stats taken from Fortnite game. • Cheating of any kind is not tolerated, and if found to be cheating will lead to immediate disqualification • by registering for the tournament, you are giving permissions for your in-game performance and stats to be tracked and made public on the public leaderboard • by registering for the tournament, you are giving permissions for PLG to contact you regarding prizes and content creation on behalf of LG Electronics. • Weekly winners of the leaderboard challenge will be rewarded with LG OLED TV. • By accepting these terms and conditions you are agreeing to be contacted by LG Electronics in the future for promotional messaging.

9 Termination of these Terms

9.1 You can terminate these Terms at any time by informing the contact point set out in the Privacy Policy in writing. We can terminate these Terms or stop providing you with all or part of the Service at any time if deemed necessary at our own discretion, for example, if you breach of these Terms or if we end all or part of the Service. Please keep in mind that while we can control our own actions, we cannot control the actions of others, including the actions of the Distributor.

10 DISCLAIMER OF WARRANTY

10.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR SERVICE ARE PROVIDED “AS IS” AND ON AN “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND FROM US, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES OR OTHER TERMS EXPRESSED, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OR TERMS OF MERCHANTABILITY, SATISFACTORY QUALITY, WORKMANLIKE EFFORT, FITNESS FOR A PARTICULAR PURPOSE, RELIABILITY OR AVAILABILITY, ACCURACY, LACK OF VIRUSES, NON-INFRINGEMENT OF THIRD PARTY RIGHTS, OR OTHER VIOLATION OF RIGHTS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US OR OUR AFFILIATES SHALL BE DEEMED TO ALTER OUR DISCLAIMER OF WARRANTY REGARDING OUR SERVICE, OR TO CREATE ANY WARRANTY OF ANY SORT FROM US. 10.2 WITHOUT LIMITING THE PREVIOUS DISCLAIMER, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DO NOT REPRESENT, WARRANT, OR GUARANTEE THAT OUR SERVICE OR THE CONTENT THEREIN WILL (i) OPERATE IN AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE MANNER; (ii) WILL BE FREE FROM ALL HARMFUL COMPONENTS OR ERRORS; (iii) WILL BE SECURE OR IMMUNE (INCLUDING THE CONTENT DELIVERED TO YOU OR THE INFORMATION YOU PROVIDED) FROM UNAUTHORIZED ACCESS; OR (iv) WILL BE ACCURATE, COMPLETE, OR RELIABLE, THAT THE QUALITY OF THE SERVICE WILL BE SATISFACTORY TO YOU, OR THAT ERRORS WILL BE CORRECTED. IN ADDITION, WE DO NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR THIRD PARTY SERVICE, ADVERTISEMENTS, CONTENT, OR ANY OTHER PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY ON OR THROUGH OUR SERVICE.

11 LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFIT, REVENUE, GOODWILL, BUSINESS, OPPORTUNITY OR DATA, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY OTHER INTANGIBLE LOSSES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO A SPECIFIC SERVICE EXCEED THE AMOUNT YOU PAID US FOR SUCH SPECIFIC SERVICE. THE LIMITATIONS OF THIS SECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE, AND EVEN TO ANY CLAIMS YOU MAY BRING AGAINST ANY OTHER PARTY TO THE EXTENT THAT WE WOULD BE REQUIRED TO INDEMNIFY THAT PARTY FOR SUCH CLAIM. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFIT, REVENUE, GOODWILL, BUSINESS, OPPORTUNITY OR DATA, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY OTHER INTANGIBLE LOSSES IN RELATION TO ANY TRANSACTION, WHERE COMPLETED OR IN PROGRESS, BETWEEN YOU AND A DEALER. YOU ACKNOWLEDGE AND AGREE THAT THESE LIMITATIONS ARE REASONABLE GIVEN THE BENEFITS OF THE SERVICE AND YOU WILL ACCEPT SUCH RISK AND/OR INSURE ACCORDINGLY.

12 Indemnification

You agree to indemnify, defend, and hold harmless us, our licensors, our agents, and all officers, directors, and employees from any and all third party claims, actions, losses, damages, liabilities, judgments, grants, costs, and expenses (including reasonable attorneys’ fees) arising from: (i) your use of our Service or use by any person that you allow to use our Service that is not in accordance with these Terms, (ii) any breach of these Terms by you or by any person that you allow to use our Service, or (iii) any violation of any laws or regulations or the rights of any third party by you or by any person that you allow to use our Service and (iv) all claims resulting from content you supply to be posted on an lg.com page.

13 Governing Law and Settlement of Dispute

These Terms shall be governed by and construed in accordance with the laws of South Africa. Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity or termination, shall be subject to the exclusive jurisdiction of the Courts of Saudi Arabia

14 MISCELLANEOUS

14.1 Survival

Any provision of these Terms that by its nature would continue to be in effect beyond the termination, cancellation, or expiration of these Terms will survive such termination, cancellation, or expiration, including, without limitation, the following sections: DISCLAIMER OF WARRANTY, LIMITATION OF LIABILITY, INDEMNIFICATION, GOVERNING LAW AND SETTLEMENT OF DISPUTE AND MISCELLANEOUS.

14.2 Entire agreement

These Terms constitute the final agreement between you and us. All prior and contemporaneous negotiations and agreements between you and us on the matters contained in these Terms are expressly merged into and superseded by these Terms. The provisions of these Terms may not be explained, supplemented, or qualified through evidence of trade usage or a prior course of dealings. In entering into these Terms, neither you nor we have relied upon any statement, representation, warranty, or agreement of the other except for those expressly contained in these Terms. There are no conditions precedent to the effectiveness of these Terms other than those expressly stated in these Terms. You may be subject to additional terms and conditions that govern your use of third party services.

14.3 Other

The parties may not amend these Terms, except by written agreement of the parties. If we do not exercise or enforce any legal right or remedy which is set out in these Terms or which we have the benefit of under any applicable law, this will not be a waiver of our rights or remedies and such rights and remedies will remain available to us. If any one or more of the provisions contained in these Terms is declared invalid, illegal or unenforceable under any applicable law, the validity, legality and enforceability of the remaining provisions contained herein shall not be affected or impaired.
