Charterparty disputes - Negotiation- Maritime Arbitration

That form of armchair criticism, or being wise after the event, is a known device of advocacy. Courts and tribunals have examined such criticisms over the years and made some observations that I have added to this collection of short quotes from arbitrators to Law Lords. You can download it for free here: https://lnkd.in/dhWQs74k A specialist LMAA Arbitrator (former mariner) noted in an unpublished award, “Like most arbitrators, I would be reluctant to criticize navigational decisions by the Master in the absence of supportive evidence that they were decisions no reasonable master could have taken” Visit the "blog" section to subscribe for free and receive a bulletin that will include (mostly) practical issues. #mariners #navigation #routing #shipmaster #nauticalassesors #shipping #crew

You present the perspective of a tipical office worker that did not have a career on sea and knows only office. The "impostor syndrome " is overpresent in the mind of those people. And it is normal, because you did not make this in the past, you did not experience in first place the fatigue, pressure, information scarcity,, incompetenci on board of ships that sometime result in a decission that is out of extraordinary. You will always have the "doubt" and not be able to confidently challenge anything decided on board. I saw also the other side of coin. A rather average ship engineer who spent his life in shipyards becoming some big technical manager for a big bank who was a school case of Dunning-Kruger effect. It occurs when a person's lack of knowledge and skills in a certain area cause them to overestimate their own competence in places like ops, chartering etc.that were not part of his work experience and training. His luck was that his boses were as incompetent as him and he could do as many mistakes he could, without consequences for him. Do challenge a Master but if you was in similar situations professionally, after you took in account all the info and factors in hand by decission maker.
