You have only answered part of my question, to put it bluntly where is the Art "Not Currently Located " you are the custodians of this Art and should be aware of the locations
Also on the "On Loan" Art who are they on loan to and where are they being kept

I have checked with the Beacon Management and am unable to provide you with any additional information.

Following a search of our paper and electronic records I have established that the information you requested is not held by the council.

The following was received from the Beacon,

"If there are rumours as to the whereabouts of the unlocated Copeland Collection items, we have not heard them and would be interested to know what the rumours are saying.

There is no current online catalogue of the Copeland Collection.

The Police would not have been involved as there was probably no evidence to suggest that the items were stolen. It is more likely a matter of not being able to locate them".

I note that these missing pieces of Art can not or have not been located is that the case ??

It seems that your response is very blaz'e to be honest .

These Artifacts are Copeland Taxpayers Crown Jewels Given to the people of Copeland.

How many people can say they have a Trevor Green oil on their walls ,a truly amazing local artist to name just one ,worth a lot of money Some may say

So in addition to my questions above please would you now list the value that each of the said Art works are insured for and also the current value
For the "missing" pieces will CBC be getting an updated valuation from the Green Family regarding the value of his stunning work .

I am sure his family would hate to think his works were in vain ,,that these items never did make up the assets for the people of Copeland instead "Heirlooms" for dignitaries/ councilors / leaders / political party's perhaps ???

If not please prove me wrong and locate them to complete the full register if not WHY not

The public have a right to know where our Crown Jewels are their worth and most importantly getting them back to some sort of safety and security

I have been asked to undertake an internal review of the previous responses to your FOI request, please find my response to your questions below.

1. Where are the missing pieces of Art.

We are currently undertaking a thorough search to ascertain whether or not the un-located works are in the museum. As some of them are quite small, they may well be in boxes. It is estimated that the search will take around 3-4 months.

2. Does the council have any intentions of locating these very valuable pieces of ART GIVEN to Copeland taxpayers to be held on the Accets Register if not WHY not ??

The value of the works will be reviewed by external, independent valuers. For missing works, the value will be assessed on similar works by the same artist.

3. Has CBC informed their insurers that Assets are missing ,if not WHY not.

Once the internal search is completed and the valuation is completed, the Council will consider whether to make a claim on Insurance or not.

4 At what point will CBC involve the police for any potential theft/loss/ missing/ damage of the said Art Work.

Once the internal search and valuation exercise is completed, the Council will consider whether or not the matter should be referred to the Police.

Regarding your request for a copy of the "Millennium Agreement" our Legal department have confirmed that the Council does not hold anything by this title? I am sorry that you were not asked to clarify this earlier but if you would like to provide a further explanation as to exactly what you mean by the "Millennium Agreement ", we would be happy to look for it for you and provide you with a copy.

Please can I suggest that you copy any response to both myself and Mr Walker as I will be on leave from this evening until the 28th November and he may be able to assist you in my absence, otherwise I will respond to you on my return.

Dear Customer Relations,

Some background information and clarity regarding my question relating to the Millennium agreement

The harbour commission were established by a scheme under a Royal charter in 1894 and all the Harbour land vested in the said Commissioner's

The Harbour land is private property and people can walk along it only .I would suggest by concent of the Commissioner and not as of right that is understood
Just as people in wheelchairs would have difficulty getting around my garden path if they can't/ don't come in as it is my garden I can chose who can come in and how to manage it

People often have a mistaken belief that harbours are there for everyone to enjoy as of right -they are not enjoyment is at the gift of the Commissioner's unless the founding legislation says otherwise
The document I have requested for, and that I was led to believe is called the Millennium agreement holds some of the following

1 What is the Commissioner's land
2 What is CBC land
3 What are the legal obligations for looking after all the land on Whitehaven Harbour ( for Commissioner's and CBC)

Whitehaven Town and Harbour acts and orders 1708-2002 and do you have a copy of this .
Who's responsible to maintain cobbles/footpaths/ weed conrol/ beaches ?
All the above questions in a scheme that highlights all of these questions

Perhaps you could ask your solicitor at the Borough council as they should know what document I am requesting

Thank you for clarifying the information which you require.

Please find attached a copy of the Whitehaven Harbour Act 2007. This Act is also available on the Legislation.gov.uk web site at http://www.legislation.gov.uk/ukla/2007/...

As you will see section 2 of that Act refers to the Millennium agreement and states that ' "the Millennium Agreement” means the agreement made between the Millennium Commission and W3M Charitable Foundation and dated 18th March 1999, as varied by the supplemental agreement made on the same date between the Millennium Commission, W3M Charitable Foundation and W3M (Trading) Limited and certified copies of which have been deposited at— (a) the offices of the Commissioners; and (b) Cumbria Record Office and Local Studies Library, Scotch Street, Whitehaven, Cumbria CA28 7NL'. The Council does not possess a copy of that Agreement as it was not a party to it. The Act deals with the dissolution of W3M and the transfer of assets to the Harbour Commissioners. The schedule to the Act details the project assets transferred. Interestingly these include pavings which you are enquiring about.

The Council also does not possess a list of assets owned by the Commissioners, you should approach the Commissioners for such information. Clearly the Council has had dealings with the Commissioners over the years and previously W3M and knows that the Commissioners own some assets like the multi-storey car park, Queen's Dock car park, etc. but it does not know the precise details or have up to date details of their ownership, nor is it required to.

In respect of the Council's land around the harbour I attach an extract from the GIS mapping system which shows ownership around the Harbour highlighted in dark purple, please note this does not include the area marked CU243092.

With regard to maintenance liabilities the Occupiers Liability Acts will control the extent of duties owed to members of public.

Finally with regard to your request for a list of assets/transfers sales belonging to the Council since 1990 it would be helpful if again, you could be more specific. For example, if you are only seeking land transfers around the Whitehaven Harbour then this can be dealt with reasonably quickly but if you really are seeking for example details of houses sold in the Borough under the right to buy process or pieces of land sold for garden purposes throughout the Borough over the last 20 years I am of the opinion that the cost of responding to your request exceeds the ‘appropriate limit ‘as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004. Section 12 of FOIA makes provision for public authorities to refuse requests for information where the cost of dealing with them would exceed the appropriate limit. The appropriate limit is set at £450; this represents the estimated cost of one person spending 2.5 working days or 18 hours in locating, retrieving and extracting the information.

1. Full list of the where about of Artwork belonging to Whitehaven

On the 18 August you registered an FOI request entitled 'Art work'- "I would like an itinerary report of ALL paintings that belong Whitehaven in storage in the Beacon and other storage and where they bare in storage please".
On the 23 August you were provided with details of the 'Copeland Collection' by Cliff Walker, the Councils' information Management Officer.
On the 29 October you replied that Mr Walker had only half answered your request and you asked further questions about the not currently located and on loan Artwork.
On the 15 November I undertook a review and advised you that the Council was undertaking an audit of its Artworks which would take approximately 3-4 months.
I can confirm that this work is ongoing and therefore you should expect a response before the end of March.

2. Full list of Artefacts belonging to Whitehaven.

3. Assets belonging to the town

On the 21 August you registered another FOI request entitled Assets - "Could you send me all asset transfers and sales of property assets belonging to CBC and /or the people of Whitehaven since 1975 to present day
In particular the Millennium agreement document relating to Whitehaven Marina showing Land Owner /Council authority ownership"
And a list of all assets belonging to Whitehaven and their locations

On the 21 August receipt was acknowledged advising you that your request would be responded to within 20 working days (giving the Council until 18 September to respond).
On the 11 September you asked why there was a delay in the Councils' response.
On the 12 September Mr Walker responded advising you that the Council had been subject to a ' Ransomware' attack on Copeland's IT systems which had severely impacted its ability to respond to all enquiries, that the ICT department were currently working to restore all affected systems and that you would be provided with the information as soon as possible.
On the 31 October you requested an internal review, which was passed to me for investigation and response.
On the 15 November I responded asking you for clarification.
On the 20 November you replied.
On the 20 December I provided information relating to the Millennium agreement document relating to Whitehaven Marina showing Land Owner /Council authority ownership.
In that same response in relations to the Assets I wrote as follows -

Finally, with regard to your request for a list of assets/transfers sales belonging to the Council since 1990 it would be helpful if again, you could be more specific. For example, if you are only seeking land transfers around the Whitehaven Harbour then this can be dealt with reasonably quickly but if you really are seeking for example details of houses sold in the Borough under the right to buy process or pieces of land sold for garden purposes throughout the Borough over the last 20 years I am of the opinion that the cost of responding to your request exceeds the ‘appropriate limit ‘as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004. Section 12 of FOIA makes provision for public authorities to refuse requests for information where the cost of dealing with them would exceed the appropriate limit. The appropriate limit is set at £450; this represents the estimated cost of one person spending 2.5 working days or 18 hours in locating, retrieving and extracting the information.

You have not replied to date to specify exactly what you mean and therefore I am unable to progress this until you do so.

In conclusion, after taking all of the above into consideration, please can you clarify exactly what you think the Council hasn’t responded to?

With regard to items 1 and 3, as previously stated this will be provided
once the Audit is complete.

 

With regard to item 2,  please find attached details of the transfer of
the councils remaining housing stock to Home Group Limited on the
07/06/2004.  By default houses within streets not shown on the attached
list were previously sold.   Additionally there are a set of plans (sample
also attached) which show the housing estates edged red which were
transferred to Home Group Limited and shaded green the properties
previously sold. There are 131 plans in total and you are welcome to come
to the Council offices and inspect the other 130 plans,  then if there is
a property you are specifically looking for we would be happy to provide
you with a copy of the relevant plan.

The Audit is now complete and the Councils' response is as follows;

Over the past six months, staff at The Beacon Museum have been systematically inspecting the Museum store looking for works of art from the Copeland Collection that had not previously been located.
Out of 82 items, only seven remain unaccounted for. Two items that had previously been unaccounted for have now been located during this audit.
Of the seven that are unaccounted for, five went missing when they were out on loan and not under the direct stewardship of the museum.

When will I get that , another 9 mth or sooner

Hello Mrs McLean,

 

I have received the following response from Julie Betteridge, the Director
of Customer and Community Services (which includes the Beacon).

 

The Council has a process for managing its collection which records
location of items.  All the items have a last known recorded location. 
These are updated when the items are moved with formal authorisation. 

Over the past six months, staff at The Beacon Museum have been
systematically inspecting the Museum store looking for works of art from
the Copeland Collection that had not previously been located.  Out of 82
items, only seven remain unaccounted for.  A small number of Items that
had previously been unaccounted for have now been located during this
audit.

The Council has within its collection seven local artworks which are not
in their last recorded locations.   This means they have either been
misplaced or have been removed from the location without authorisation. 
We are wholly alert to the fact that they are unaccounted for and will
remain vigilant in the course of our work, as we have been since they were
first unaccounted for.  

Two of them were last recorded in our internal stores:  Old Town Hall
(watercolour) by Edward (Eric) Lyon and Houses, Duke Street (painting) by
Trevor Green.   It is highly likely these have been misplaced and we
continue to look as we use and work in our stores. 

The remaining five pieces were in office locations when they were last
recorded.  Three of these were logged as last being in CBC offices prior
to the move to our new offices in Whitehaven in 2004: North Pier
(watercolour) by Trevor Green, Cleator Moor (watercolour) by Edward (Eric)
Lyon and Customs House (watercolour) by Edward (Eric) Lyon.  We no longer
use these buildings.  We suspect the artworks were lost or misplaced in
the move.  The remaining painting artwork was out with an external partner
in a local office building as the last recorded location in 2009:  Looking
Down Duke Street (watercolour) by Trevor Green.  This partner has since
moved out of this office building which is now empty and the artworks
appear to be misplaced/lost in the move.  The final artwork is a
photograph: Scafell (photograph) by Robert Savage.  The last known
physical location was with an external partner who changed the use of that
location.  Later recorded locations are ‘unknown’.  Our position is that,
knowingly or not, unauthorised persons have removed these five items
without recording the new location.

These local artworks were bought for their local significance as part of
our duty to record and preserve the heritage of Copeland.  We are
disappointed that they have been removed from the Collection without the
appropriate recording being undertaken in line with our clear process for
managing the collection items.  Six are local landmark artworks by two
local artists, the seventh artwork is a photo of a local landmark.

The previous audit to this one was in 2014. The missing ones were all
missing prior to that date. 

The artists’ families have not been informed because in line with the
purchase documentation, the paintings were purchased outright so, apart
from copyright of the image, the artist has no further rights in it.

Thank you for te reply ,still find 7 missing is 7 to many that do not belong to CBC but the people of Whitehaven and would like some clarification
Missing
1, no 23 North Pier ..Trevor Green
2. no28 Old Town Hall
Both missing from CBC offices

3. No. 30 Cleator moor Square .. Edward Lyon Missing from CBC Members Room 2005 but not reported missing until 20011 can you answer that please

4. no41 photo "scaffell " Roger Savage unknown
5. No 52 oil Cargo Ship ...Desmond G.Sythes not mentioned in your list also missing from Beacon 2005

6. No 68 Parton....Percy Kelly not located no record ????

7 no, 75 Duke st ...Trevor Green explained again another missing from Beacon 2012

8, no. 77 looking Down Duke st .. Trevor Green This one by your own records was missing from Union Hall Confrence Rooms 2009 ,could you explain who access was given to in this meeting room

9. No 59 pencil "Black Combe " William Wilkinson on loan to who do you know ?????
10 no 60 pencil Wasdale William Wilkinson on loan to who do you know ????
11. No 61 pencil Whitehaven harbour ,,,William Wilkinson again on loan to who do you know????

You have accounted for 7 no 28 75 both missing from Beacon stores one from 2012 why was nothing done before now to find the please explain

Again I would like an explanation , if you knew this art work to be "Missing why was nothing done before or who had the authority at that time

And are we to assume the others HAVE been found there is or was 12 missing from your own list

Also can you clarrify no 59 ,60, 61 from the Copeland Bowling Club
Cleator Moor have they been found or again on loan to who and do you know who too

Please find below a final response from Julie Betteridge, Executive
Director with line management responsibility for the Beacon Museum.

 

I consider that your questions regarding the Artwork Audit and missing
artwork have been answered and will not be providing any further
information.

 

I can confirm that Copeland Borough Council do hold a definitive list of
artefacts.  The database is managed by the Beacon Museum and is held on
the MODES system, which holds in excess of 30,000 individual entries.
  However, access to the system is strictly limited and the information
relating to locations and values is restricted for security purposes in
accordance with curatorial guidelines.

 

The appropriate redaction of the database would involve the manual
retrieval and processing of in excess of 30.000 individual records.  It is
estimated that each review would take a minimum of 3 minutes, highly
likely more. This equates to a minimum of 1,500 hours or £37,500 based
upon an hourly rate of £25.00.

 

Under section 12(1) of the Freedom of Information Act 2000, a public
authority is not obliged to comply with a request where the estimated cost
of doing so would exceed the appropriate limit of £450.00.

 

I am sorry but your request has therefore been refused in accordance with
section 12 of the Freedom of Information Act 2000 as the cost of
compliance would exceed £450.00.

 

The Council makes every effort to make sure that the services it provides
are as efficient and effective as possible, and this includes any requests
under the Freedom of Information Act.   If you were to simplify the
request, for example by highlighting the particular item or items of
interest to you and submit a new request, we may be able to provide you
with some information.  

 

Otherwise, please note that the Council now consider the review of your
FOI request closed.  If you believe that your request has not been dealt
with satisfactorily, you may refer the matter to the Information

I find this unbelievable that.you cannot or will not answer what you are doing about this missing art
I will reiterate to you once again the Council are full custodians of this Artworks and fully responsible for it where abouts not just this present council but it's past members are also accountable

And find it unreal you are doing absolutely nothing about it

As for the Artifacts will you confirm that it is sitting in a container on Kells and a lot was thrown away during the BNFL take over

I would just report the matter to the Police. The Council has admitted that certain items have been taken without lawful authority and in any statutory definition that is an indication of theft contrary to the Theft Act 1968. Let the Police investigate....sadly they may just be told by CBC to keep out.....and they might
